CaPow Technologies Ltd. (“CaPow”) warrants that Genesis (“Product”) is free of defects in design, materials, and workmanship under normal use. The Product is covered under this Standard Warranty for a period of 12 months from the date of installation, as evidenced by a valid invoice (the “Warranty Period”). CaPow shall provide only components for replacement if such components are found defective under this article, as per CaPow’s sole discretion.
Should you discover during the Warranty Period any defect in the Productwhich is covered by this Standard Warranty and you wish to make a warranty claim, you must notify CaPow via email at support@capow.energy, together with the sales receipt attached and your contact information.
CaPow shall have the sole authority to determine warranty coverage, type, and means of repair in the event of a warranty claim. CaPow shall have the right to require the return of the defective material to CaPow or its authorized distributor to establish the claim. If, per CaPow’s sole discretion, it is determined that a Product is defective due to issues covered by warranty within the Warranty Period, You agree that your exclusive remedy, and CaPow’s entire liability, under this Standard Warranty shall be the repairment of the Product or the replacement by technical support at no charge for covered defects.
Parts which are repaired and replaced during the warranty period will be warranted for the remainer of the original Warranty Period.
Any replaced Product will be considered CaPow’s property, and you shall have no property rights in such returned Product.
All costs of shipping under this Standard Warranty shall be borne by the purchaser. If CaPow reasonably determines that a repair or replacement iscovered by this Standard Warranty, CaPow will reimburse the purchaser the cost of shipping the repaired or replaced Product to the purchaser.
CaPow shall not be liable for the customer’s indirect, incidental, special and consequential damages result from the use of, or inability to use the Product or failure of the Product, including but not limited to loss of business, loss of economic advantage, loss of labor, loss of profits or loss of goodwill arising out of or in connection with the sale, use or performance of the Product.
This Standard Warranty is offered only with respect to Products which are purchased directly from CaPow. This Warranty may only be used by the purchaser of the Product and is non-transferable and non-assignable to any third party.
[This Warranty does not apply to: (i) any cables, power adapters, or batteries supplied with the Product; (ii) any cosmetic damage, including but not limited to scratches and dents; (iii) any damage caused by non-CaPow products or components, or use of products or components not compatible with the Product; (iv) any damage caused by accident, abuse, misuse, negligence, improper shipping, natural causes, flood, fire, or earthquake; (v) any Product or part of it that has been modified or tampered with, or to damage caused by operating the Product outside the permitted or intended uses described by CaPow; (vi) any damage caused by a third party service (including upgrades and expansions), unless such upgrades were performed according to CaPow’s express, written instructions; (vii) any Product or a part of it that has been modified or altered without the prior written permission of CaPow; (viii) if the Product serial number has been removed or defaced; or (ix) to any damage caused by software or a virus.]
This Standard Warranty shall be governed by and construed according to the laws of the State of Israel. Exclusive jurisdiction is hereby granted to the applicable courts in the Tel Aviv-Jaffa district.
